Traffic Tickets in Raleigh

Traffic law can be a complex and confusing system to navigate alone.  Even if you plan to plead guilty and pay your Raleigh traffic ticket in full, it is important to hire an experienced attorney who will defend your rights throughout the legal process and help you get the fairest possible sentence.

Strict Liability Offenses

The majority of Raleigh traffic tickets are issued for “strict liability offenses”.  This means that evidence of criminal intent is not needed in order to convict the defendant; what matters is that the defendant committed the offense.  Common examples of strict liability traffic offenses include the following:

  • Driving at a speed exceeding the designated  limit
  • Not using turn signals, or driving a car with malfunctioning headlights
  • Committing  a parking offense, such as not paying a meter, or parking in a handicapped space
  • Failing to yield or to stop at signs or traffic lights

Misdemeanors and Felonies

Many traffic violations are small infractions, such as not yielding or forgetting to use the turn signal.  Infractions usually result in a moderate fee.  Other traffic violations are considered misdemeanors, which can incur a heavy fine, substance abuse education, or community service--and sometimes time in jail.  Examples of traffic misdemeanors include the following:

  • Reckless driving
  • Driving while intoxicated
  • Leaving the scene of an accident
  • Driving without a valid license or insurance

Felonies are the most serious type of traffic violation, often resulting in lengthy imprisonment terms and permanent suspension of driving privileges.  Traffic felonies may include severe offenses such as:

  • Repeated DUI convictions
  • Cases of hit-and-run driving
  • Committing homicide with a vehicle

Legal Advice in Traffic Law

If an officer has charged you with a violation and given you a traffic ticket in Raleigh, it is important to seek legal counsel, no matter how insignificant the ticket may seem.  Remember that a traffic ticket can add points to your license, as well as drive up the cost of your monthly insurance premiums.
